The rule againest hearsay developed through fear of the unreliablility of hearsay evidence .However,the common law recognised that ,in certain circumstances,evidence that was technically hearsay to be admissible.There was no generral exception allowing hearsay to be admitted on the basis of it's reliability ;raather,the common law developed piecemeal exceptions which have reliabilities as their basis.
Hearsay which forms part of the res gestae may be admissible.The res gestae exception covers remarks made by participants and observers of events in the circumstances where the remark is so bound up in the event that it can be safty admitted.
