自从中国加入WTO以来,人民币汇率问题一直成为中美经贸关系乃至国际社会的热点问题,2008年全球金融危机爆发后,美国对人民币汇率指责又有所加剧.近些年来,来自不同地方和国家要求人民币升值的呼声也越来越高.从国际法角度看待人民币汇率问题,人民币汇率的管辖权则是一个值得深入讨论的问题.论及中国人民币汇率的管辖权,一般都认为当由IMF协定管辖.但是近些年来,国际社会一直存在着关于人民币汇率制度违反WTO法律制度的指控.关于汇率争议始终没有通过法律途径解决,而是采用了贸易制裁为要挟、通过谈判达成妥协的政治方式.因此,寻求人民币汇率争议的法律解决,我们不应当去回避这个问题.相反,应该积极利用法律途径应对这些非难,从而避免一直受到的政治压力.本文希望通过对GATT相关条款的分析,得出WTO对人民币汇率争议是否具有管辖权,如果西方国家向WTO争端解决机构提起诉讼,我国又改如何解决这些问题.

About currency dispute never resolved through legal channels, but adopted trade sanctions to coerce, negotiated a compromise political way. Therefore, seek the RMB exchange rate controversial legal solution, we should not go to avoid this problem. Instead, should actively use legal ways to avoid addressing these reproach, always by political pressure. This paper hope to GATT related terms by analysis and comparison of the WTO dispute to the RMB exchange rate has jurisdiction over whether, if western countries to the WTO dispute settlement body filed a lawsuit, our country again change how to solve these problems.
