浅析地役权与相邻关系
摘要：相邻关系与地役权虽都是与不动产的利用有着密切的联系、作用功能相似的两种制度,但是二者在产生依据、法律性质与效力以及受到侵害时救济方式等方面都存在极大差异.相邻关系属于最小限度不动产利用的调整,是实现相邻不动产和谐利用的必要前提,认识相邻关系的关键在于如何判断最小限度利用.从妨害相邻关系的判断标准入手论证：凡是属于最小限度利用的情形,必然构成相邻关系.除此以外的不动产利用应以地役权约定实现.所以相邻关系属于对不动产权利的限制或延伸,地役权则是一种约定权利,属于用益物权.本文通过对二者的比较,找出它们之间的联系和区别,以能够在日常司法实践中更好地处理这对极易混淆的法律关系.

Abstract:Relationswithneighboringeasementsand real estateutilization, althoughareclosely linked, the role ofthe two systemswith similar functions,but bothin the productionbasisand thelegal natureand effectivenessinfringed uponremedies, etc. There area great difference.Minimaluse ofreal propertybelonging tothe adjacentrelationshipadjustmentis to achievea harmonioususe ofreal propertyadjacent toa necessary prerequisite forunderstandingthe relationshipliesadjacent tohow to determine theminimaluse.Fromprejudice tothe criteria for determiningthe adjacentrelationshipto startargument:those who belong tominimizethe use ofthe case,necessarily constituteneighboring relations.In addition tothe useof real propertyeasementagreementshould beimplemented.Soadjacentrelationshipto real propertyrightsbelonging tolimit orextendthe easementis a kind ofcontractual rights,belong tothe usufructuary.Based on thecomparison between the two,findlinks and differencesbetween them,in order tobe able toeverydayjudicial practicebetter handlethiseasily confusedlegal relationship.
