代孕现象的法律问题研究
随着现代医学的技术的发展,代孕技术作为一项人工生殖辅助技术,是在20世纪90年代才产生的.它的产生给人类没有生育能力的夫妇带来了福音.然而由该技术引起的代孕行为会涉及很多伦理及法律上的相关问题.在法律方面极具探讨价值,代孕行为颠覆了传统的生殖观念和法律制度.对此,各国立法对其态度不一.我国已于2001年立法禁止代孕.然而,现实中的代孕却是禁而不止仍然大量存在的.基于此,笔者认为绝对禁止代孕并非上策.法律应以一种务实的态度来面对,与其简单禁止不如审慎规范.本文将主要从对国内外的代孕法律制度进行分析比较,探讨我国代孕行为是否应该合法化、代孕所生子女的法律地位、代孕的法律调控等基本法律问题,对促进社会的和谐具有重要意义.

With modern medical technology,technology as a surrogate assisted reproductive technology,is only 90's in the 20th century produced.It produces a human infertile couples brought the gospel.Caused by the technology,however,surrogacy involves many ethical and legal related issues.On the great value in the law,on behalf of the pregnant reproductive behavior of the traditional concept of subversion and the legal system.In this regard,the different attitudes to their national legislation.China has legislation to prohibit surrogate in 2001.However,in reality,despite being banned surrogate is still a lot there.Based on this,I believe that the absolute prohibition of surrogate is not the best.The law should adopt a pragmatic attitude to face,rather than simply ban as prudent norms.This article will focus on the domestic legal system of surrogacy analysis and comparison of our acts should be legalized surrogacy,surrogate child born of the legal status of the legal regulation of surrogacy and other basic legal issues,the promotion of social harmony of great significance.
